The Jammu and Kashmir High Court on Monday observed that the central government “should not treat people of Kashmir as aliens but its own people.”
Hearing a Public Interest Litigation, a division bench of Chief Justice N Paul Vasanthakumar and Justice Muzaffar Hussain Attar told the central government counsel: “They (people of Kashmir) are not aliens, they are your own people, and you don’t treat them as your own people. They have not descended from the outer space.”
“If the country’s Home Minister is saying avoid its (pellet gun) use, why didn’t you find any alternative?” the court observed, after going through the central government’s response according to which “CRPF personnel deployed in Jammu and Kashmir for maintaining law and order duties are experienced and fully trained to use anti-riot equipment.”
“Each functional battalion of CRPF has seven companies of which one is always put under training on rotation basis to refresh their operational skills and acquaint themselves with the latest technology. They are not companies formed by collecting trainees/recruits from training centres,” read the central government’s response.
“If they (forces) are trained, how people got injured like this? It (pellets) should be used below knee but the fact is people have received injuries in eyes and on face,” the court asked the government counsel.
“You can’t scuttle it. We have evidence on record produced by the government about the pellet-hit persons. You have to follow Standard Operating Procedures (SOPs),” the court observed.
Disagreeing with the government’s submission that the forces deployed in Kashmir for are trained, the court observed: “It is good to mention on papers but the ground reality is different. People have suffered injuries in eyes and chest, quite above knees. You are not explaining how these injuries happened.”
In response to the submission by the petitioner that the doctors who have come from outside do not find cooperation to work here, the Court told the Advocate General, Jahangir Iqbal Ganai: “Why is it so. This is the problem created by the State itself. You use pellets. Your own people suffer and you have taken doctors from outside to treat them.”
In a separate observation, the Court on Monday told the Jammu and Kashmir Bank that it was its duty to ask the company whose internet services it has hired to resolve the problem of non-functional ATMs.
“It is a commercial activity. It is your duty to make them (ATMs) functional. J&K Bank is the official bank; you are sons of the soil and you have to come forward and work. Ensure that every employ gets salary, everyone gets pension,” the Court told the Bank authorities, observing that “in these abnormal times the bank authorities have to prove their mettle.”
“Which restrictions you impose. Under section 144 of CrPC, restriction is on the number of persons,” the court asked the AG.

இதற்கு பதில் அளித்துள்ள பாஜக அரசு, ”காஷ்மீர் கலவரத்தை கட்டுப்படுத்த திறமையான CRPF வீரர்களையே நாங்கள் அனுப்பியுள்ளோம். அவர்களுக்கு பிரத்யேகமாக பயிற்சி அளிக்கப்பட்டுள்ளது” எனக் கூறியுள்ளது.
இதை கேட்ட நீதிபதிகள், அவர்களுக்கு பயிற்சி அளிக்கப்பட்டிருந்தால் பிறகு ஏன் மக்கள் இப்படி காயப்பட்டுள்ளாா்கள் முகத்திலும் கண்களிலும் ஏன் இப்படி அவர்களுக்கு படுகாயம் ஏற்பட்டுள்ளது? நீங்கள் (மத்திய அரசை பார்த்து) எதையும் எங்களிடம் மூடி மறைக்க முடியாது பெல்லட் குண்டுகளால் பாதிக்ப்பட்டவர்களின் ஆதாரம் எங்களிடம் உள்ளது என” நீங்கள் நடத்தை விதிமுறைகளை கடைபிடிக்க வேண்டும் என மத்திய அரசை கடுமையாக கண்டித்துள்ளனர்.

பாதிக்கப்பட்டவர்களுக்கு சிகிச்சை அளிக்க வெளியில் இருந்து கொண்டு வரப்பட்டுள்ள மருத்துவர்களுககு உரிய ஒத்துழைப்பு அளிக்கப்டுவதில்லை என்ற குற்றச்சாட்டு குறித்து விசாரித்த நீதிபதிகள், இது மாநிலத்தின் பிரச்சனை , அதற்காக நீங்கள் பெல்லட் குண்டுகளை பயன்படுத்துகின்றீர்கள் , காயப்பட்டவர்களுக்கு சிகிச்சை அளிக்க வெளியில் இருந்து மருத்துவர்கள் வரவழைக்கப்படுகின்றார்கள் என்ன இது ? என Advocate General, Jahangir Iqbal Ganai ஐ பார்த்து நீதிபதிகள் கேள்வி கேட்ட அவரால் பதில் சொல்ல முடியாமல் போனது.
